JACQUELYN FRADETTE is a trial lawyer who represents clients in all areas of litigation. Jacquelyn has tried cases through arbitration, as well as in state and federal court. Her experience broadly ranges from ligation strategy, pre-complaint analysis through trial, with a particular focus on hearings, depositions, fact witness and expert testimony.
Jacquelyn has represented clients in commercial litigation and class action litigation arising under statutes such as the False Claims Act, Lanham Act, state consumer protection laws, state common law false advertising, breach of contract, and business tort claims, as well as federal and state constitutional claims. Jacquelyn also represents clients in civil actions against government entities.
Jacquelyn has litigated on behalf of, and provided litigation counseling to, clients in a broad range of industries including developers and manufacturers of pharmaceuticals and biologics, OTC monograph drugs, cosmetics, dietary supplements; energy companies; oil and natural gas companies; outdoor advertising companies and publishing businesses; electronic financial transaction organizations; medical device manufacturers; and genetic testing companies.
Jacquelyn’s recent representations include:
- Member of trial team representing health and lifestyle company in a trademark dispute in federal court, and successfully defeated several motions to exclude expert testimony and a motion for summary judgment.
- Member of trial team representing energy company in complex proceeding, with over a dozen intervenors, against governmental energy bureau challenging aspects of upcoming 20-year Integrated Resource Plan, achieving all requested relief
- Member of trial team representing Clear Channel Outdoor in suit challenging the First Amendment constitutionality of a tax levied on billboard publishers.
- Obtained summary judgement in a class action against a major electronics retailer alleging misleading sales price practices, eventually leading to full dismissal of the case.
- Successfully defended global sunscreen brand in parallel consumer class actions pending in multiple federal jurisdictions alleging the product did not provide the labeled SPF protection.
- Successfully represented a global pharmaceutical company in a consumer class action alleging false and misleading claims on labeling of 20 dietary supplement products that resulted in a complete defense verdict.
- Successfully represented a global dietary supplement brand, obtaining a complete voluntary dismissal of Lanham Act competitor lawsuit challenging client’s flagship product.
