Representative matters include:
- Represented a global integrated resort company and senior executives in securities and shareholder derivative litigation in the U.S. District Court for the District of Nevada and won a motion for reconsideration of a motion-to-dismiss ruling, resulting in dismissal of all claims.
- Represented a Big Five technology company in a putative class action pursuant to the Illinois Biometric Information Privacy Act in Illinois state court, and successfully obtained dismissal of the complaint without prejudice, followed by plaintiffs voluntarily dismissing the case.
- Represented a major technology company in a putative BIPA class action and a related individual action in the Northern District of Illinois. After discovery, plaintiffs in both actions voluntarily dismissed the case with prejudice.
- Represents a financial institution in False Claims Act litigation in parallel proceedings in multiple jurisdictions.
- Represented a global integrated resort company in defense of federal securities litigation in the U.S. District Court for the District of Nevada and successfully obtained summary judgment, which was affirmed by the U.S. Court of Appeals for the Ninth Circuit.
- Represented a public company in defense of consumer class action in the U.S. District Court for the District of Arizona.
- Represented a healthcare technology company and successfully defeated class certification in putative class action brought under the Telephone Consumer Protection Act (TCPA) in the U.S. District Court for the Northern District of Illinois.
- Representing clients in non-public government investigations, including before the DOJ, SEC and CFTC.
- Secured dismissal of a putative securities class action against a multinational quick service restaurant company in the U.S. District Court for the Western District of Kentucky, which was affirmed by the U.S. Court of Appeals for the Sixth Circuit.
- Represented Chicago Loop Parking LLC (an asset owned by Morgan Stanley Infrastructure Partners) in an arbitration resulting in a $62 million judgment in favor of our client, which was contested in the Circuit Court of Cook County and affirmed by the Illinois Appellate Court.
