November Antitrust Bulletin: Top-of-Mind Global Antitrust Issues

Welcome to the Sidley Antitrust Bulletin — thoughts on topics that are top of mind for Sidley’s Antitrust team and why they matter to you. The U.S. antitrust agencies have continued to try to expand antitrust enforcement. The Antitrust Division of the Department of Justice (DOJ) made news when it recently obtained a guilty plea in a criminal monopolization case for the first time in decades, and the U.S. Federal Trade Commission (FTC) issued a new policy statement regarding its intention to use its Section 5 “unfair methods of competition” authority. Across the Atlantic, the European Commission (EC) is also revising the public guidance regarding some of its practices, and it just started a public consultation on the revision of its Market Definition Notice. With respect to U.S. enforcement, the DOJ has been embracing theories of harm relating to buyer power, including through its investigations into labor issues and in recent merger litigation.
