Buy (More) American: New Proposed Rule to Strengthen Buy American Requirements for Federal Procurements

On July 30, 2021, in furtherance of President Joe Biden’s January 25 Executive Order1 to encourage the use of federal procurements to support American businesses and workers, the Department of Defense, General Services Administration, and National Aeronautics and Space Administration announced a proposed rule intended to strengthen the Buy American Act requirements in the Federal Acquisition Regulations (FAR).2 Interestingly, the notice seeks public comments not only on the proposed changes to the FAR but also on related matters in Executive Order 14005 that are outside the scope of the proposed rule yet aim to provide the FAR Council with additional insights on government procurement rules and processes and their effects on American competitiveness and supply chains.
