MORGAN BENNETT LINDSAY helps clients navigate the complexities of regulatory environments, focusing primarily on representing freight railroads in matters before the Surface Transportation Board (STB) and federal courts.
As a large part of her transportation practice, Morgan represents Class I railroads. She advises her clients on a variety of regulatory topics, including STB and Interstate Commerce Commission (ICC) precedent, STB and Federal Railroad Administration (FRA) regulations and guidance, preemption under the ICC Termination Act (ICCTA) and the Federal Railroad Safety Act (FRSA), abandonment proceedings, rate and demurrage disputes, disputes between rail carriers, petitions and comments related to proposed STB rulemakings and agency hearings, and federal court review of agency action.
Morgan also provides transportation regulatory due diligence for transactions involving railroads or rail assets and supports clients in other regulatory environments, including telecommunications matters involving the Federal Communications Commission (FCC) and the California Public Utilities Commission.
Morgan is based out of Sidley’s Los Angeles office but continues to work closely with her colleagues in Washington, D.C., where she was based for four years.
