As Superfund sites become larger, more expensive, and more technically complex, the prospect of allocating the costs of those sites among numerous parties can be daunting. In many cases, private allocation can be an efficient and effective way of allowing Superfund Potentially Responsible Parties to achieve their collective and individual goals. But to achieve a positive result, participants must lay the correct groundwork early in the process, develop the record, advocate effectively, and work together toward resolution.
Distinguished neutral allocator Bill Hengemihle (FTI), investigators and consultants Dennis Farley and Kate Lasseter (TIG Environmental), and environmental lawyers Larry Kirsch and Jack Raffetto (Sidley) focused on the Superfund allocation process.
