Our team has provided on-the-ground legal counsel for many significant toxic tort incidents, including pipeline leaks, refinery explosions, and fires at chemical plants and other industrial facilities. Recent examples of our work include representing:
- Sterigenics, as it confronts litigation, regulatory, and legislative threats arising from the use of ethylene oxide as a sterilizing agent for millions of critical medical devices and surgical kits. Sidley is providing strategic crisis management support, preparing and implementing a toxic tort and environmental litigation defense strategy, and counseling the client in its approach to regulatory agencies. The firm obtained a full defense victory in a trial in Cook County, where plaintiffs claimed that exposure to ethylene oxide led them to develop cancer and other injuries, leading to a settlement of all 800+ claims filed in that jurisdiction.
- GE, as national coordinating counsel and trial counsel in asbestos litigation. For more than three decades, we have assisted GE in obtaining dozens of summary judgments, dismissals, and trial victories extricating GE from numerous asbestos cases in this long-running litigation.
Several global companies facing asbestos litigation and mesothelioma claims based on allegations of exposure to asbestos-containing talc in cosmetics products. - A refinery in an Indiana class action seeking damages for personal injuries, property devaluation, and medical monitoring following a flood that caused groundwater infiltration into homes. After a lengthy jury trial, Sidley secured a defense verdict, which was preserved through an appeals process ending in the U.S. Supreme Court.
- Superior Refining Company and Husky Energy in litigation arising out of a refinery explosion. Sidley was onsite within hours, handling immediate crisis management and responding to government inquiries and investigations. Sidley also assisted in handling prelitigation claims and successfully defended Superior in class action and multi-plaintiff litigation in which onsite personnel, contractors, suppliers, and community members claimed emotional distress, personal injuries, economic damages, and property damage.
- A manufacturer of products used in in vitro fertilization (IVF) procedures in nationwide litigation alleging that the products were toxic and destroyed embryos and gametes, including claims for personal injury, lost property, emotional distress, and wrongful death. Following the company’s recall of the products, Sidley has been coordinating not only the nationwide response, but also the company’s international response around the world.
- Defending companies sued in their first cases alleging asbestos exposure from talc.
