We have vast experience representing diverse clients defending and prosecuting trademark infringement claims in both federal and state courts in many venues across the nation. Such cases often begin with an expedited demand for temporary restraining orders or preliminary injunctions. Sidley lawyers are adept at handling such fast-paced litigation, and our IP lawyers bring a special level of focused experience to these complex matters.
We represented a coffee company in parallel federal court and Trademark Trial and Appeal Board proceedings against a candy company which alleged infringement of a trademark for food products. We recently represented a major entertainment company in a trademark suit involving alleged infringement of a mark relating to a sports franchise and successfully obtained dismissal of the complaint. Similarly, in the Northern District of Illinois, we served as co-counsel for defendants in a trademark infringement suit regarding the soundtrack from a popular television series. Summary judgment was entered in favor of our client, and the ruling was affirmed on appeal.
Our trademark litigation experience has also covered a wide variety of consumer products, from computer software to book titles to tractors. Our group is active in Internet-related trademark claims, including prosecuting actions against domain name cybersquatters and both prosecuting and defending claims of infringement arising out of Internet-based activities.
