Together with the firm’s Insurance practice, our Employee Benefits and Executive Compensation practice is among the very few with extensive experience with unique investment funds offered by 401(k) plans known as stable funds. The investment options resemble bond funds, except that they use special insurance and similar financial contracts (“wrap contracts”) to provide principal plus a stable rate of return and rather than being reported at daily fair market value. Our experience involves representing plans and collective investment funds that offer stable value funds, as well as advising the issuers of the financial contracts on the ERISA and other regulatory aspects of such contracts.
